Terms of Service
Please read these Terms of Service carefully before using the Digital Legacy website and services. By placing an order or using our website, you agree to be bound by these terms.
1. About Us
Digital Legacy is a United Kingdom–based media digitisation service. We convert analogue media, including video tapes, cine film, audio tapes and photographs, into digital formats. These terms govern your use of our website at digital-legacy.me and the services we provide.
2. Placing an Order
When you place an order through our website, you are making an offer to purchase our digitisation services. We will confirm acceptance of your order by email. A binding contract is formed when we send this confirmation. Prices are as quoted on our website at the time of ordering and include VAT where applicable.
We reserve the right to refuse or cancel any order if the media contains illegal content, if we believe the order to be fraudulent, or if the media is damaged beyond our ability to process it safely.
3. Your Responsibilities
By sending us media for digitisation, you confirm that:
- You own the copyright to the recordings, or you have the legal right or permission to have them copied.
- The media does not contain illegal content.
- The contact and shipping details you provide are accurate and complete.
We focus on personal and family media. We do not knowingly copy commercially produced content (feature films, television broadcasts, commercially released music) unless you can demonstrate that you hold the rights.
4. Shipping and Transit
We provide a free, tracked, insured media box for sending your items to us. If you choose to use your own packaging instead, we strongly recommend using a tracked and insured service. We are not liable for items lost or damaged by the postal service during transit to our facility. Once your media arrives at our lab, it is insured and in our care until we return it to you via tracked, insured delivery.
We are not responsible for delays caused by postal services, customs, adverse weather, or other circumstances beyond our control.
5. Our Digitisation Process
Every item we receive is inspected and, where necessary, cleaned and repaired before transfer. Minor repairs (tape splicing, shell replacement, pressure pad replacement) are included at no extra charge. If we identify damage that prevents safe playback or requires significant intervention, we will contact you before proceeding.
We use professional-grade equipment and take every reasonable precaution to protect your media during the transfer process. However, some items, particularly very old, mouldy, or severely deteriorated tapes and films, carry an inherent risk of further damage during playback, regardless of the equipment used. By sending us your media, you acknowledge and accept this risk.
6. Turnaround Time
Our standard turnaround time is 10–14 working days from the date we receive your media. This is an estimate, not a guarantee. Processing times may vary depending on order volume, the condition of your media, and the complexity of the transfer. We will keep you informed of progress and notify you if there are any expected delays.
7. Payment
Payment is due after digitisation is complete and before we dispatch your original media and digital files. We accept payment via the methods listed on our website. If payment is not received within 30 days of our invoice, we reserve the right to charge a reasonable storage fee for holding your media.
8. Satisfaction Guarantee
If you are not satisfied with the quality of a transfer, please contact us within 14 days of receiving your files. We will review the issue and, where possible, re-transfer the item at no additional cost. This guarantee covers the technical quality of our transfer work; it does not cover limitations inherent to the source format (for example, VHS recordings will always be standard definition).
For full details on what to expect, output quality by format, turnaround times, and our damage policy, please see our Happiness Guarantee page.
9. Cancellation and Refunds
You may cancel your order at any time before we begin processing your media. If cancellation is requested after processing has started, we may charge for work already completed. If we are unable to transfer an item (for example, because the tape is blank or damaged beyond recovery), you will not be charged for that item.
Refund requests should be directed to admin@digital-legacy.me. We aim to resolve all refund requests within 14 working days.
10. Liability
We take the utmost care with your media, but in the unlikely event that an item is damaged or lost while in our possession, our liability is limited to the reasonable replacement cost of the blank media (for example, the cost of a new blank VHS tape). We are not liable for the sentimental, emotional, or commercial value of the content recorded on the media.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.
11. Intellectual Property
You retain full ownership of the content on your media. We do not claim any intellectual property rights over your recordings, photographs, or other content. We will not copy, distribute, or share your content with any third party.
All content on our website, including text, images, logos and design, is owned by Digital Legacy and protected by copyright. You may not reproduce, distribute, or use our website content without our written permission.
12. Data Protection
We process your personal data in accordance with our Privacy Policy, which forms part of these terms. By using our services, you acknowledge that you have read and understood our Privacy Policy.
13. Force Majeure
We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, postal disruption, power failures, or government action.
14. Changes to These Terms
We may update these terms from time to time. Changes will be posted on this page with an updated date. Your continued use of our services after changes are posted constitutes your acceptance of the revised terms.
15. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Contact Us
